2. Governing Law

These terms, all policies on this website, and any disputes arising from the use of Deucks products or services are governed by the laws of New South Wales, Australia. By using our products, you agree that any legal proceedings shall be conducted in the courts of New South Wales, Australia.

3. Australian Consumer Law

Deucks products and services are supplied in accordance with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in our terms or policies excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies under the ACL and cannot be excluded.

Consumer Guarantee: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

4. Export Restrictions

Deucks products and services are developed in Australia and are subject to Australian export control laws and regulations, including but not limited to:

4.1 Defence Trade Controls Act 2012

Under the Defence Trade Controls Act 2012 (Cth), certain goods, software, and technology are controlled for export from Australia. Deucks applications are consumer-grade software products and are not classified as controlled goods under the Defence and Strategic Goods List (DSGL). However, users must not:

  • Use Deucks products in connection with the development, production, or use of weapons of mass destruction
  • Export or re-export Deucks products to countries or entities subject to Australian sanctions
  • Use Deucks products for any purpose prohibited by Australian or international law

4.2 Autonomous Sanctions

Australia maintains autonomous sanctions against certain countries, individuals, and entities under the Autonomous Sanctions Act 2011 (Cth) and the Autonomous Sanctions Regulations 2011. Deucks products and services may not be supplied to, or used by, sanctioned persons or entities. Users are responsible for ensuring their use of Deucks products complies with all applicable sanctions laws.

4.3 End-Use and End-User Controls

Even where Deucks products are not specifically listed as controlled items, export may be restricted based on the end-use or end-user. Users must not use Deucks products for any military, nuclear, chemical, or biological weapons-related purposes.

5. Privacy and Data

Deucks complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Any personal information collected through our applications or website is handled in accordance with these requirements.

  • Personal information is stored securely within Australia or in jurisdictions with equivalent data protection standards

All content, code, designs, trademarks, and intellectual property associated with Deucks products and this website are owned by Deucks or its licensors. You may not reproduce, distribute, modify, or create derivative works from any Deucks materials without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law (and subject to consumer guarantees under the ACL that cannot be excluded), Deucks' total liability for any claim arising from the use of our products or services is limited to the amount paid by you for the relevant product or service in the 12 months preceding the claim.

Deucks is not liable for any indirect, incidental, consequential, or special damages, including loss of profit, data, or business opportunity, except where such liability cannot be excluded under the ACL.

8. Third-Party Platforms

Deucks applications may be distributed through third-party platforms including the Apple App Store and Google Play Store. These platforms have their own terms of service, privacy policies, and legal requirements that apply in addition to our terms. We encourage you to review the applicable platform's terms.

9. Changes to These Terms

We may update this page from time to time to reflect changes in law, regulation, or business practice. Material changes will be communicated through our website or applications. Continued use of Deucks products after changes are posted constitutes acceptance of the updated terms.
